Kathmandu. The Commission of Inquiry (CIAA) has said that the case filed against former Prime Minister KP Sharma Oli and former Home Minister Ramesh Lekhak does not fall under its jurisdiction.
The commission has made it clear that it does not have the authority to take criminal action. In a statement issued on Thursday, the commission said that the responsibility of investigation and prosecution lies with the government mechanisms.
“The Commission has been mandated to conduct a thorough investigation into the physical and human losses that occurred during the demonstration on September 7 and 24 in relation to the jurisdiction and responsibilities of the Commission, to conduct a factual inquiry into the incidents and submit a report with definite opinions and suggestions, to accept and analyse the information or application related to physical and human damages and to give necessary opinion regarding the course of action,” the statement reads.
The commission has stated that it does not have the authority to directly investigate or prosecute criminal crimes.
“It is not within the jurisdiction of this commission to conduct a detailed investigation into a criminal case and even prosecute the accused if they are found guilty. “It is well known that Nepal law has authorised anyone involved in criminal offences to get the government mechanisms to take immediate investigation and action,” the NHRC said in a statement.
