Kathmandu. A total of 1,076 complaints have been lodged at the District Code of Conduct Monitoring Committee and monitoring officers for violating the election code of conduct, 2082, according to the Election Commission.
At a press conference organized here today, Commission’s Joint-Secretary and Spokesperson Narayan Prasad Bhattarai said that 1,061 (99 per cent) of the settlement has been settled. The highest number of complaints have been registered in Lumbini Province with 244 complaints. The lowest number of complaints have been registered in the Far-Western State at 96. Of the complaints received, 97 (9 per cent) were written and 979 (91 per cent) were received through telephone, SMS and other sources.
According to him, most of the complaints were related to the use of large scales, banners and flags, misuse of social media, noise pollution by playing DJ microphones, use of flags in public places and vehicles without permission, among others.
The EC has continued the process of carrying out necessary investigation into the complaints received and taking action in order to minimize the incidents of violation by ensuring effective enforcement of the election code of conduct. The Central Code of Conduct Monitoring Committee, District Code of Conduct Monitoring Committee, Code of Conduct Monitoring Officer, Security Bodies and the offices of the concerned Election Officer are active for the effective implementation of the code of conduct. Out of 254 complaints received at the Central Code of Conduct Monitoring Committee (CIAA), clarification was sought in 88 complaints including email, personal registration and the media, 57 responds have been received, according to the NHRC.
Four political parties asked for clarification
Out of the clarifications sought from the EC, the number of clarifications sought from the political parties is four and the number of clarifications sought from the candidates is 33. Apart from this, 51 clarifications have been sought from government÷educational institutions÷employees and other people. Province-wise Koshi Province has eight, Madhes Province 13, Bagmati Province 40, Gandaki Province six, Lumbini Province seven, Karnali Province four and Sudurpaschim Province four.

In order to minimize the incidents of violation by enforcing the code of conduct, the EC has taken a decision after seeking clarification from the concerned political parties, candidates and bodies as part of the process of necessary investigation into the complaints received by the EC.
The meeting also decided to impose a fine of Rs 25,000 on Shakti Bahadur Basnet, the candidate for the member of the House of Representatives from Jajarkot constituency-1 of the Election Commission Act, 2073 and Clause 48 (1) of the Election Commission Act, 2073 BS for violating the clause (i) and (n) of the sub-section (i) and (n) of the election code of conduct, 2082.
The Election Commission has decided to slap a fine of Rs 25,000 on Dr Kamal Bhusal (Nicholas Bhusal), the candidate of Nepal Janasewa Party in Rupandehi constituency-2 for the House of Representatives election-2082 and clause 23 (3) of the Election Commission Act, 2073 and Clause 48 (1) of the Code of Conduct.
The meeting decided to impose a fine of Rs 25,000 as per the sub-section (3) of the Election Commission Act, 2073 and the sub-section (1) of the Clause 48 of the Election Code of Conduct, 2082 and the sub-section (d) of the Clause 13 of the Election Code of Conduct.
Khagendra Sunar and Shobha Pathak were alerted by the EC

The meeting was decided to caution Khagendra Sunar, the candidate of the Rastriya Swatantra Party (RSP) for the by-election to the member of the House of Representatives from Banke constituency-3, not to make statement in violation of the election code of conduct.
Januka Pathak (Shobha), who was the candidate of Nepal Janasewa Party in Bhaktapur constituency-2 in the House of Representatives election 2082, warned not to misuse the iconic shoes that were soaked in blood during the Jenji movement.
Two provincial coordinators of Gorkhapatra Sansthan have been reinstated
According to the EC, the meeting decided to allow Madhes province-level office coordinator Dharmendra Kumar Jha and Bagmati province-level office coordinator Shaligram Nepal to continue their duties in violation of the clause 7 (f) and (g) of the election code of conduct, 2082.
Departmental action recommended against Dhorpatan Hunting Reserve Chief Chaudhary and teacher Thakur of Shree Secondary School
According to the EC Spokesperson Bhattarai, the meeting decided to direct the Ministry of Forest and Environment to take departmental action as per Clause 42 (1) of the Civil Service Act, 2049 and Section 44 of the same Act against Ramdev Chaudhary, chief of Dhorpatan Hunting Reserve Office under the Ministry of Forest and Environment, by making malicious and derogatory statements in social networking sites against the election code of conduct, including the Clause 7 (a) and (i) of the Election Code of Conduct, 2082 ।
The meeting also decided to direct the Ministry of Education, Science and Technology to take departmental action against Dip Narayan Thakur of Shree Secondary School in Mithila Bihari Municipality-5 of Dhanusha district for his involvement in political activities and violate clause (a) of Article 10 of the Election Code of Conduct, 2082.
