. KATHMANDU: The main opposition Nepali Congress (NC) has reiterated its demand for an impartial and thorough investigation into the controversies surrounding the incidents of September 7, 2002, the non-transparent working style of the Commission and the decisions taken by the government in recent days. “The government’s move is against the rule of law, selective and politically motivated,” the statement said.

The Nepali Congress had on September 9 through a high-level commission demanding investigation into the incident of Daman 24 and action against the culprits.TAG_OPEN_p_47 Reiterating the same demand, the Central Work Execution Committee (CWC) led by the then Vice-President Purna Bahadur Khadka on September 12 had urged the government to carry out an impartial investigation into the incidents of both the days.

According to the Congress, from the very beginning, the party has been unwavering in favor of a legal, transparent and unbiased investigation into both the incidents.TAG_OPEN_p_46

A meeting of the party held from March 2 to 20 after the election had demanded the government to make public the report submitted by the Gauri Bahadur Karki-led probe commission.TAG_OPEN_p_45 The Congress has said that the government has not made the report public in a legitimate manner so far.

According to the party, the mere fact that the commission “failed to investigate” the events of September 24 is enough to raise questions about both the completeness and impartiality of the report.TAG_OPEN_p_44

Quoting the comments received in the media, the NC claimed that the EC had looked into the events of September 23 in detail but ignored the incidents of September 24.TAG_OPEN_p_43

According to the Congress, this behavior is not only against the rule of law but also strengthens the question of impartiality raised by the Supreme Court.TAG_OPEN_p_42

At a time when the then Sushila Karki-led government had decided to make the report public only after studying it, the meeting of the Council of Ministers held on March 26 has accused the government of adopting different behaviour in the recommendations of the commission.TAG_OPEN_p_41

The NC has commented that the government’s ‘TAG_OPEN_p_40 selective behaviour’ in the points of the same report by taking immediate action while forming a ‘study committee’ on the security mechanism and initiating the arrest process in a hurry is a proof of the government’s ‘selective behavior’ on the points of the same report.

According to the party, such a move has increased the risk of weakening the rule of law in the country, undermining the judicial process and politicizing the incident.TAG_OPEN_p_39

The Nepali Congress has said that the people should get clear information about who was involved in the suppression of September 23 and the arson and vandalism of September 24.TAG_OPEN_p_38

The party is of the view that the culprits of both days, whoever they are, should be punished according to the legal process.

The Congress, however, warned that the action needed to be “lawful, not provocation and impulse”.TAG_OPEN_p_36

According to the party, if the government loses patience and makes hasty decisions, the country can again be pushed towards conflict, instability and mistrust.TAG_OPEN_p_35
