Kathmandu. KATHMANDU: The Supreme Court (SC) has refused to issue an interim order in the case relating to the formation of the government under the leadership of Sushila Karki and the dissolution of the House of Representatives on her recommendation.
“The contents of the petitioner’s demand for interim order are also in nature to be considered during the final hearing of the writ petition,” reads the order.
A constitutional bench comprising Chief Justice Prakash Man Singh Raut and Justices Sapana Pradhan Malla, Kumar Regmi, Hari Prasad Phuyal and Dr Manoj Kumar Sharma issued the order today. The writs filed against the dissolution of the House of Representatives have also sought a written response within seven days.
The order reads, “A copy of this order and the writ petition should be kept along with a copy of this order and the writ petition along with the notice period issued in the name of the respondent and after the receipt of the written reply or after the expiry of the period for the written reply.” ”
President Ram Chandra Poudel had dissolved the House of Representatives on September 27 on the recommendation of the interim government. A total of 16 writ petitions have been filed at the apex court demanding the annulment of the appointment of the interim Prime Minister, annulment of the dissolution of Parliament and mandamus order to reinstate the Parliament.
Advocates Prem Raj Silwal, Yubaraj Poudel, Kirtinath Sharma Poudel, Ayush Badal, Makabul Miya, Khadka Bahadur Shah, Dambar Prasad Shiwakoti, Dal Bahadur Dhami, Prakash Bhujel and Bipin Dhakal, Abhas Pokharel, Om Prakash Jung Shah, Bimal Pokharel, Dr Punya Prasad Khatiwada and Sher Bahadur Rokaya have also filed the writ against the House dissolution.
The hearing on the writ petition began at the Constitutional Bench of Annex Building from today after the main building of the Supreme Court was completely destroyed in the fire on September 10.
