Kathmandu. The Advertisement Board has urged all sides concerned to conduct examination of such advertisements immediately and fulfill the legal process by disseminating the audio, visual and audio-visual advertisements through various media without obtaining approval from the Board.
The notice issued by the Board on Monday stated that the advertisement material did not mention the name, address of the advertiser and mandatory details including the warning message and the advertisements were also being aired with the intention of misleading the consumers by including the baseless and exaggerated material.
According to Section 15 (b) of the Advertisement (Regulation) Act, 2076 and Rule 5 of the Advertisement (Regulation) Regulations, 2077, the Advertisement Board has the authority to examine and permit the advertisement material. Likewise, the Advertisement Materials Broadcast Testing Standard, 2078 (First Amendment, 2080) is in force.
According to the Board, all the audio, visual and audio-visual advertisement materials broadcasting in Nepal will have to be tested by the Advertisement Board before broadcasting. The Board has also directed the government to immediately examine the advertisement materials being broadcast without testing them and to remove the advertisement materials that are against the law immediately.
The board has also warned of action as per the prevailing laws if the advertisement was found violating the legal provisions.
