Kathmandu. They have demanded the government to immediately resolve the legal complexities surfaced in the land trade, land dispute and land transfer. Stating that not only businessmen, but also the general public, construction sector, banking system and the entire economy have been affected due to the legal and administrative confusion seen in the real estate business, it has been urged to seek a long-term solution.
Entrepreneurs have said that the demarcation of land has become a major obstacle for systematic urbanization and housing development. They have also demanded amending the existing legal provisions related to demarcation and creating an environment conducive for the real estate and housing development companies operating with approval to manage the required land and carry out transactions.
Through the legal amendment of 2078 BS, the real estate and housing development companies that had taken permission from the concerned body were allowed to purchase additional land required for the operation of real estate business in the residential area. However, they say that the entrepreneurs are in trouble after the ban on sale, distribution or transfer of land beyond the limit limit.
Entrepreneurs have said that the provision of allowing additional land for commercial purposes but prohibiting the sale or transfer of the same land is contradictory. They claim that due to such arrangements, a large amount of land has been frozen and the entrepreneurs who have already built residential projects are not able to sell their structures and properties easily.
They have demanded clear legal provisions for the release and management of land beyond the limit. Entrepreneurs have said that the government should be serious to create an environment conducive for the land and residential projects that have been stalled for a long time to be carried out through the legal process.
Likewise, the committee has also demanded not to take unnecessary arrests and actions against entrepreneurs who are in the process of demarcation and have not been able to sell their land due to legal complexities. They insist that the problems created by the legal ambiguity of the past should be addressed from a solution-oriented approach rather than criminalizing it.
Permanent policy required on plotting
They have also demanded the government to immediately end the confusion seen in the land plotting. The entrepreneurs have demanded a clear, stable and practical policy saying the provision of land plotting has become uncertain due to the repeated amendments in the land laws and various decisions.
According to them, not only the real estate entrepreneurs but also the general public have been directly affected by the opening and closing of the plots. Problems have also surfaced in house construction, sale of land, division of shares, management of collateral for banking purposes and management of family property.
Entrepreneurs have stressed the need for long-term management of land-sharing process through scientific land use policy, clear criteria and digital system. It also urged the government to make clear legal and administrative provisions that would provide a long-term solution rather than making temporary decisions time and again.
Land Transaction Needs Continuity
It has also demanded to create a transparent, systematic and continuous business environment by ending uncertainty seen in land transactions. Entrepreneurs say that the legal and administrative confusion seen in the real estate sector has affected banking, construction, employment, industry and overall economic activities.
They said that the government should create clear policies and a stable legal environment to make the real estate sector systematic. They argue that the fluctuations in real estate transactions affect everything from the banking system to the market of construction materials and employment, so the solution to the problem should be linked to the overall economic activities.
Seven-point demand from the government

KATHMANDU: Entrepreneurs have put forth a seven-point demand to the government to resolve the problems surfaced in the land trade.
1. The statute of limitations should be amended immediately.
2. Make clear provisions for the release of land belonging to real estate and residential projects that have been stalled due to the border restriction.
3. Legal avenues should be opened for real estate companies operating with approval to keep the required land for commercial purposes and to sell the constructed houses easily.
4. Adopt a solution-oriented approach without criminalizing the problems created by the legal ambiguities of the past.
5. Resolve the problems related to plotting in a long-term manner and make a permanent standard.
6. Create an environment where land transactions can be operated transparently, systematically and continuously.
7. Solve the problem should not be limited to the interest of businessmen but should be taken forward in the interest of the general public, housing development, construction, banking sector and the entire economy.
Entrepreneurs have urged the government to end the tendency of taking temporary decisions time and again and resolve the problems of the real estate sector through long-term, clear and practical legal reforms. According to them, a stable policy and clear legal provisions will increase transparency in real estate transactions and have a positive impact on housing development, construction, banking and employment generation.
