Kathmandu. Kathmandu: A constitutional bench has been formed at the Supreme Court to hear the writ petitions filed against the dissolution of the House of Representatives.
The constitutional bench comprising Chief Justice Prakash Man Singh Raut and Justices Sapana Pradhan Malla, Kumar Regmi, Hari Prasad Phuyal and Dr Manoj Kumar Sharma has been constituted to review the case, according to SC spokesperson Arjun Prasad Koirala.
President Ram Chandra Poudel had dissolved the House of Representatives on September 27 on the recommendation of the interim government. In this connection, a total of 16 writ petitions have been filed at the Supreme Court demanding mandamus on the appointment of the interim Prime Minister, annul of the House of Representatives and reinstatement of the parliament.
According to the court administration, the writ petition will be heard in the Constitutional Bench of Annex Building from today at a time when the performance of the Supreme Court was affected due to the arson of the main building of the Supreme Court on September 24.
All works except the filing and hearing of habeas corpus applications and urgent petitions were halted after the court was damaged by arson, stone-pelting, vandalism and looting in course of the Jenji agitation on September 24. Writ petitions were filed against the dissolution of the House of Representatives after the writ petition was registered and the hearing opened on October 28.
Advocates Prem Raj Silwal, Yubaraj Poudel, Kirtinath Sharma Poudel, Ayush Badal, Makabul Miya, Khadak Bahadur Shah, Dambar Prasad Shiwakoti, Dal Bahadur Dhami, Prakash Bhujel and Bipin Dhakal among others have filed the writ petition.
Earlier, a full court meeting of all the justices including Chief Justice Prakash Man Singh Raut had decided to register and hear the writ petitions on October 28.
The Supreme Court’s ‘digital’ system has been ‘recovered’ due to arson and vandalism during the Genji movement. Spokesperson Koirala said that with the recovery of this system, the data of the cases under consideration and which have already been decided has been found safe. Currently, hearing is taking place in the Supreme Court by conducting only five benches.
