Kathmandu. The Supreme Court (SC) has refused to issue an interim order on a writ petition filed by former Nepali Congress President Sher Bahadur Deuba and outgoing acting President Purna Bahadur Khadka.

In the writ petition filed naming the Election Commission as the defendant, Deuba and Khadka had demanded an interim order to stop the activities related to the Nepali Congress general convention.TAG_OPEN_p_9

TAG_OPEN_p_8 The Full Bench has said that it is not necessary to issue the order as per the demand of the petitioners on the basis of the order passed by the Joint Bench on April 17, 2083.

Earlier, the joint bench had dismissed the writ petitions filed by Deuba and Khadka, concluding that there was no need to annul the decision of the Election Commission on January 15, 2002.TAG_OPEN_p_7

} The Full Bench made it clear that the old order did not give any order or direction to the petitioner or the defendant to take any further action or decision. The court said that the execution of the judgment can be stayed in the event of an order of review under Section 231 (d) of the Civil Procedure Code, 2074, but the order dated April 17 has dismissed the application without issuing any actionable direction.

KATHMANDU: The Supreme Court (SC) has ordered to move the dispute as per the law in a writ petition filed under Section 156 of the Civil Procedure Code, 2074 BS.
