Patan High Court issues interim order on Mahakali bridge construction dispute

Mahendranagar. The Patan High Court today issued an interim order in response to a writ petition filed by Kumar-CFEC JV, the company awarded the contract for the construction of a four-lane concrete bridge over the Mahakali River in Kanchanpur.

The company had filed a writ petition at the Supreme Court last Friday naming the Department of Roads, Road Improvement and Development Project Directorate and Laxmi Sunrise Bank as defendants.TAG_OPEN_div_18

A single bench of Patan High Court Judge Khadananda Tiwari issued the interim order as per the High Court Regulations 2073 Rule 42910 in the name of the defendants without implementing the issue of deposit of the amount as performance guarantee and return on bail from the Road Improvement and Development Project Directorate, Kathmandu, said engineer of the bridge construction company Kumar-CFEC JV, Kishor Raj PandeyTAG_OPEN_div_16 ।

The Directorate of Improvement and Development had issued a seven-day notice on Friday regarding the termination of the contract agreement and clearance of the Mahakali Bridge as 94 percent of the construction work has been completed.TAG_OPEN_div_14 The bridge construction company, Kumar-CFEC JV, had written to the Mahakali Bridge Project Office in 2082 Baisakh citing the delay in the approval of the new design and variation order (VO) of the guidebund.

The construction company had earlier filed a case at the Patan High Court, blaming procedural dilly-dallying in the project.TAG_OPEN_div_12 The Patan court has sent the case to the arbitration tribunal. The case is currently pending at the arbitration tribunal. Estimated at an estimated cost of Rs 3.77 billion, 94 percent of the bridge construction had been completed three years ago.
