100 days of government: From protecting public land to returning the money of cooperative savers

Kathmandu. KATHMANDU: The report of the High-Level Rawal Commission on Government and Public Land Investigation and Conservation has come into implementation after 31 years.
The government has pledged to implement the recommendations pointed out in the report of the Rawal Commission formed in 1998 by giving priority to the protection of government and public land in course of implementing the provisions included in the 100 TAG_OPEN_div_177-point agenda issued by the incumbent government.
An eight-member committee has been formed under the coordination of Deputy Director General of the Survey Department, Krishna Prasad Sapkota, to implement the recommendations mentioned in the commission’s report.TAG_OPEN_div_175
As mentioned in the report, the Ministry of Land Management has clarified that the transaction of all the plots of land (buying, selling, namsari or any other means) related to the encroached land of 1,859 ropanis has been stopped.TAG_OPEN_div_173

Acts, Rules, Procedures, Provisions and Amendments
The Ordinance designed to amend some Nepal Acts to facilitate service delivery related to land administration has been amended to amend the Land (Metrology) Act, 2019, Land Revenue Act, 2034, Land Use Act, 2076, Forest Act, 2076 and Land Act, 2021.TAG_OPEN_div_168
Similarly, the Cooperatives (First Amendment) Ordinance, 2083 has amended the law to address the problems of the cooperative sector immediately.TAG_OPEN_div_166 The Cooperatives (First Amendment) Rules, 2083, the Land (First Amendment) Rules, 2083, the Land (Second Amendment) Rules, 2083 and the Land Revenue (Ninth Amendment) Rules, 2083 have been issued.
Likewise, a draft of a new bill related to land (TAG_OPEN_div_164 measurement), land and cooperatives is being prepared. A bill designed to consolidate and amend the laws related to Guthi is being formulated. The bill designed to amend the Cooperative Act, 2074 is being prepared to make timely reforms to the Cooperative Act, 2074. The draft of the Kamiya Labour (Prohibition) (First Amendment) Regulations, 2082 is being prepared.
Savings returned to the savers of the problematic co-operative {TAG_CLOSE_div_162}}

Giving priority to the return of savings of the savers of the problematic cooperatives, the government has decided to return the savings of the problematic cooperatives to the province and local levels by organizing the fifth meeting of the thematic committee in accordance with the clause 22 (sub-section (1) of the Coordination and Interrelations Act, 2077.TAG_OPEN_div_161
Dilliraj Acharya has been appointed as the chairman of the problematic cooperative management committee and Nawaraj Simkhada and Roshan Bahadur Shakya as members.TAG_OPEN_div_159 KATHMANDU: The “Working Procedure on Establishment and Operation of Savings Withdrawal Circular Fund of Members of Problematic Cooperatives, 2083” has been approved and published in the Nepal Gazette on April 26.
In the current fiscal year TAG_OPEN_div_157 2082÷83, Rs 250 million has been released against the request of the Ministry of Finance for budget management in the circular fund. As of June 18, 2083, 1,452 small savers of eight cooperatives have been repaid their savings amount.
Savings Return, Loan Recovery and Asset Management Procedure, 2083 has been approved and implemented. Around 44,000 demand applications for the return of savings are being processed in a phased manner.
Software system has been developed to be used by the office staff as per the procedure for calculating the debt liability of the borrower. The recommendations of the Commission of Inquiry on Irregularities in Cooperatives-2082 have been implemented.
The report submitted by the Commission of Inquiry, 2082 (2 TAG_OPEN_div_151 082) into the alleged irregularities in the cooperatives formed by the Council of Ministers of the Government of Nepal on May 24 under the convenorship of former High Court Justice Binod Prasad Sharma. A committee has been formed for the implementation of the report.
Recommendation has been made to conduct detailed investigation and action against ÷the officials and employees of the regulatory bodies involved in the registration, approval, branch office÷service center approval, expansion of scope and merger of cooperatives.
As per the decision of the Council of Ministers of the Government of Nepal on June 3, 2008, the Land Problems Resolution Committee has been formed under the chairmanship of Balbhadra Bastola with Amir Prasad Neupane, Padma Nidhi Soti and Dr Rehana Shrestha as members.TAG_OPEN_div_147 Integrated digital data collection and verification of landless squatters and unsystematic settlers has begun. A District Land Problems Resolution Committee has been formed in each district with the Chief District Officer as its chairperson.
Procedures related to completion of remaining works of past commissions, committees and task forces for the effective implementation of the work of the Land Problem Resolution Committee, 2083, Work Procedure on Providing Land to Landless Dalits, Squatters and Unorganized Settlers, 2083, Basis and Criteria for Identification and Verification of Landless Dalits, Landless Squatters and Unorganized Settlers, 2083 and Procedures Relating to Collection of Records of Landless Dalits, Landless Squatters and Unorganized Settlers, 2083 has been approved and issued.
Kathmandu: The Ministry TAG_OPEN_div_143 of Infrastructure Development has coordinated and facilitated with the Ministry of Infrastructure Development for the collection of integrated digital data collection of landless Dalits, landless squatters and unsystematic settlers in the Kathmandu Valley.
According to the Ministry, the meeting held virtual discussions with the central office-bearers of the Land Problems Resolution Committee and member-secretaries of the 77 districts of the Land Problems Resolution Committee regarding the activities÷programs to be carried out by the committee.TAG_OPEN_div_141 The integrated digital data collection and verification of 1,620 people including landless Dalits, landless squatters and unsystematic settlers has been done since March 26.
Land Administration Services Operated by Local Level
A total of 2 TAG_OPEN_div_138 14 applications were received from the local levels that want to provide the services provided by the Land ÷Reform Administration Office (currently the Land Administration Office) and the Survey Office from the local level. After this, the government has selected 35 local levels to work for land administration in the first phase.

Mero Kitta Mobile App

The Ministry has developed the ‘Mero Kitta Mobile App’ and made it public on June 21. The app can be used to print map, take down field book, take down plot register, apply for field drawing and pay revenue and download map, field book and plot register and print as required.

The Land Management and Training Centre, Dhulikhel has fully implemented the GIOMS system and digital signatures have been used.TAG_OPEN_div_114 The NRA has introduced the Financial Cooperative Regulation System for effective regulation, monitoring and supervision of the cooperatives doing the main transaction of savings and loans.
As of June 22, 12,225 cooperatives have been registered under the online registration÷recording system.TAG_OPEN_div_112 Among them, licenses of 3,668 cooperatives have been issued.
Hello Sarkar and the multi-channel system has been arranged to address the complaints and suggestions related to the ministry received from the citizens. The Ministry and its subordinate bodies have an arrangement of information officers and grievance hearing officers, while a WhatsApp hotline has also been set up to register complaints at the Ministry.
Information officers and complaints are addressed to the information and suggestions received through telephone. Arrangements have been made for service seekers and citizen help desk at the Land Administration Office.

The entry of middlemen in the Land Revenue and Survey Office has been controlled and managed in coordination with the District Administration Office. My kitta mobile app has been built.
Work Process Restructuring Reform Report, 2083 has been prepared. Directives have been issued to all divisions of the Ministry and all bodies under the Ministry to ensure compliance of eight different topics mentioned in the Civil Service Act-2049 BS and Civil Service Employees Code of Conduct Regulations-2065.
Revenue collection and revenue rebate

A total of Rs TAG_OPEN_div_99 17.67 billion has been collected from the Department of Land Management and Records and its subordinate bodies from March 2082 to May 2083. During the period, Rs 1.64 billion has been exempted from revenue while passing instruments in the name of women, single women and Dalits.
A total of Rs TAG_OPEN_div_97 398.42 million has been collected from the Survey Department. During this period, the Debt Recovery Tribunal has collected Rs 4 million 83 thousand in revenue from various cooperatives registered with the Debt Recovery Tribunal through the registration of complaint applications and loan recovery process.
The National Cooperative Regulatory Authority (NCRA) has collected Rs 74 million 35 thousand in revenue. According to the Ministry, Rs 41.4 million revenue has been collected from the Land Management Training Centre till mid-June. A revenue of Rs 32 lakh has been collected from the Cooperative Training and Research Centre.
The Ministry TAG_OPEN_div_93 of Land Management, Cooperatives, Federal Affairs and General Administration has forwarded the report implementation process for the protection of government and public land by prioritizing the 100-point agenda issued on the day of the formation of the incumbent government.
