Kathmandu. KATHMANDU: The Department of Land Management and Records has issued a 9-point circular to the Land Revenue Offices to systematize the transaction, release and record management process of land and property that have been frozen by banks and financial institutions.
The circular issued by the Department has directed the banks and financial institutions to maintain uniformity in the process of updating, lifting the frozen records and transferring the land and assets that have been frozen as loan security.
Now, the details of the frozen property should be clearly recorded and an official letter from the concerned bank or financial institution should be submitted for the release of the blocked. It is stated that the concerned office should proceed with the process only after making further confirmation in case of double transaction, unauthorized transfer or different details in the records.
“The JRO shall verify the document received for verification pursuant to clause (j) of sub-section (4) of Management and Archives 392 and if it is found that all the details are correct and the fees required as per the rules have also been paid, submit it to the LRO. The LRO will have to approve the withholding document and release the withholding rather than release it. As per this provision, the computer print should be released in the withheld letter, the computer, the sealed records and the records should also be released and the concerned authority should be informed and only if the computer is not printed, the concerned representative should come and fix the document. In the case of the separated offices, it has been said that a letter of deed should be written to the office which has tameli records and the same should be informed to the bank and landowner.
The Department has directed the Land Revenue Offices to update the digital record system, enter the details received from banks and financial institutions on time and adopt special precaution to avoid errors in the details related to the blockade. The circular also urged the government not to cause unnecessary trouble to the service seekers in the process of lifting the blockade, transferring the mortgage and transfer of the name and also to provide service as soon as possible as per the law.
“As per the provision in clause (d) of sub-section (4) of Section 392 of the directive, the office should verify and approve the details related to the withholding and release received in first priority. ” the circular said.
