There is no dispute over constitution of constitutional bench: Chief Justice Raut

Kathmandu. Kathmandu: Chief Justice Prakash Man Singh Raut has said that there are no disputes and differences in the constitution of the constitutional bench. A bench of Chief Justice Raut, senior-most justices Sapana Pradhan Malla, Dr Nahakul Subedi, Til Prasad Shrestha and Binod Sharma has been formed today.

The Chief Justice said that the bench was formed using the constitutional right to appoint four judges appointed by him.

Article 137 of the Constitution provides for the constitution of a constitutional bench. There will be a constitutional bench in the Supreme Court in 910. The bench will consist of the Chief Justice and four other judges appointed by the Chief Justice on the recommendation of the Judicial Council.

“There was no dispute over the formation of the constitutional bench and the constitutional bench could not be set up due to the urgent work of appointment and transfer of judges,” Chief Justice Raut told reporters today. ’

Stating that many misconceptions were being spread about the constitution of the constitutional bench, he said, “There is a clear provision in the constitution regarding the formation of the constitutional bench. ’

He said that although the discussion on the issue of streamlining the constitutional bench was discussed during the discussion of the one-year action plan in the full court of the Supreme Court, there was no dispute.

The constitutional bench, which was stalled for some time in the meantime, has come into operation from today. There are 228 cases in the constitutional bench.
