Supreme Court issues mandamus to expedite transitional justice

Kathmandu. KATHMANDU: The Supreme Court (SC) has issued a mandamus order to investigate the cases related to transitional justice and conclude it at the earliest.

The constitutional bench TAG_OPEN_div_15 comprising Acting Chief Justice Sapana Pradhan Malla and Justices Manoj Kumar Sharma, Dr Nahakul Subedi, Abdul Aziz Musalman and Tek Prasad Dhungana issued the mandamus order today.

“A mandamus order has been issued in the name of the government to implement the previous orders and directive orders on the issue of obstruction of access to justice,” Supreme Court Spokesperson Arjun Prasad Koirala said TAG_OPEN_div_13 । ”

The Constitutional Bench has ruled that the Act Related to the Commission of Investigation on Enforced Disappeared Persons (Third Amendment) (Third Amendment), 2081 BS is constitutional as it has been amended as per international standards, Supreme Court verdict and law.TAG_OPEN_div_11 The senior-most member of the displaced Constituent Assembly (CA) Kul Bahadur Gurung and advocate Dr Gyan Bahadur Basnet had filed a writ naming the Office of the Prime Minister and Council of Ministers as the defendants, terming the third amendment of the Act as unconstitutional and demanded that the complaints of both the commissions be investigated and brought to its conclusion soon.

In the third amendment to the Act, the word “serious violation of human rights” has been replaced with “violation of human rights” or “serious violation of human rights” in various places.TAG_OPEN_div_9 The writ petition had demanded that only the word ‘serious violation of human rights’ should be included.
