Kathmandu. The government has introduced the ‘Federal Civil Service Bill, 2083’ with the objective of making the Federal Civil Service more systematic, transparent, accountable and politically neutral.
The bill prepared to amend and integrate the existing laws related to the federal civil service has proposed sweeping changes in the service structure of employees, appointments, transfer, promotion, retirement, facilities, conduct and discipline.TAG_OPEN_div_137

11 services, 6 clusters
TAG_OPEN_div_131 According to the bill, the federal civil service will have 11 services including economic planning and statistics, engineering, agriculture, justice, foreign affairs, administration, auditing, forestry, miscellaneous, education and information technology. For service specialization up to the thirteenth level, 6 clusters have been made including engineering, agriculture and forestry, justice, foreign affairs, administration and audit.
hierarchical system removed {

The bill proposes to replace the existing hierarchical system and implement a hierarchical system. According to this, the gazetted special category will have a chief secretary and chief registrar at the fourteenth level and a secretary at the thirteenth level.
Similarly, it has been proposed that the twelfth and eleventh levels will have joint secretaries or hundreds, the tenth and ninth levels will have under-secretaries or hundreds, and the eighth and seventh levels will have sections officers or equivalent to them. 49 per cent inclusive reservation

The bill provides for open competition, inter-level competition and promotion for the fulfillment of posts. There is a proposal to reserve 49 percent of the posts in the open and inclusive posts.
TAG_OPEN_div_121Half of the 49 per cent posts allocated for reservation will be reserved for women. It is proposed to include Khas Arya, indigenous nationalities, Madhesis, Dalits, Tharus, Muslims, backward regions and disabled groups.
The remaining half of the reserved posts will be contested between indigenous nationalities, Madhesis, Dalits, poor Khas Arya, Tharus, Muslims, backward regions and groups with disabilities. The reservation provision will be reviewed every 10 years.
Proposal to make the transfer system cyclical and transparent

TAG_OPEN_div_116 It has been proposed to set up a Civil Service Board to make employee transfers predictable, transparent and cyclical. The Chief Secretary will be the chairman of the board.

60 years of compulsory retirement{

The bill proposes to keep the mandatory retirement age of civil servants at 60 years. However, it is proposed to apply the transitional provision to the employees who have completed 55 years of service or have completed 30 years of service at the time of the commencement of the Act.
The term of the fourteenth level officer will be two years and that of the thirteenth level officer is three years.TAG_OPEN_div_106
Likewise, the bill has also included provisions to promote employees who have served in the same category for 15 consecutive years to the higher class one month before retirement and increase the level of employees who have completed certain service period and outstanding performance.TAG_OPEN_div_104
from salary to housing and health insurance

According to the bill, the employees will get salary and allowances from the day they join the service. A provision has been proposed to provide festival expenses equal to one month’s salary every year.
Contribution-based pension will be arranged for new employees. It has also been proposed to implement term life insurance, accident insurance and educational insurance up to the bachelor’s level for the children of the employees.
The bill also has provisions to provide housing loan to the employees at a cheap interest rate once during the service period and to implement contribution-based health insurance scheme.TAG_OPEN_div_96
Strict political activity

The bill proposes to strictly enforce the political neutrality of civil servants. It has been proposed that the employees will not be allowed to take membership of any political party or its sister organization, participate in elections, engage in political campaigning and participate in demonstrations, strikes or lockouts.
Similarly, anyone working elsewhere, becoming a consultant or running a business without prior approval has also been banned.TAG_OPEN_div_90
Two years ‘cooling period’ after retirement{

A cooling period of two years has been proposed after retirement for senior officers of special or first class. During this period, they will not be allowed to work as consultants on any constitutional, diplomatic or foreign and development partner projects.
The bill proposes to prohibit employees from obtaining or applying for a Permanent Residence Permit (PR-DV) from a foreign country.TAG_OPEN_div_84
Code of Conduct for Social Media Use

Civil servants are not allowed to comment for or against political parties or political officials through social media. Similarly, activities that increase violence or affect social harmony have also been banned.
Action can be taken for offences ranging from delay in discharge of duty, consumption of alcohol, violation of conduct or indiscipline to withholding of salary increase. In serious cases, departmental punishment ranging from removal or dismissal from service has been proposed in the bill.
Overall, the Federal Civil Service Bill, 2083 has proposed restructuring of the civil service in line with the federal structure, transparency in staff management, political neutrality, responsibilities based on performance and legal management of employees.TAG_OPEN_div_76
