Kathmandu. The Supreme Court has issued an interim order to the government-formed Property Investigation Commission not to proceed with any work.
A division bench of Justices Tek Prasad Dhungana and Shreekanta Poudel issued the interim order today.
“The questions raised in the present writ petition are of serious constitutional and legal nature. The interim order has been issued as it has been found that the investigation by the commission and asking for property details may cause irreparable damage to the privacy and legal rights of the people if the case is not finalized. ‘
Advocate Prem Raj Silwal has filed a writ petition at the apex court questioning the legitimacy of the Property Investigation Commission.
The government on April 15 had formed a five-member commission under the convenorship of former Supreme Court Justice Rajendra Kumar Bhandari. Other members of the commission are former Supreme Court judge Purushottam Parajuli, former judge Chandiraj Dhakal, former sub-inspector of Nepal Police Ganesh KC and charter accountant Prakash Lamsal. The commission has been mandated to investigate the properties of high officials since 2062 BS.
